The relationship between union members and addiction treatment centers is a rocky one. In the past, some rehab centers used scams to drain as much out of their health insurance as possible. However, not all union members addiction treatment centers do that. Many rehab centers can provide addiction treatment to union members, but it’s important for people to know their rights.
Union Members Addiction Treatment Scam
Firstly, it’s important to address the elephant in the room. In 2018, reports revealed that some rehab centers tried to scam union members and hold them against their will. These scams started when members asked their unions to find mental health or addiction recovery centers for them. However, the facilities took advantage of union rules in the process.
For example, the treatment centers must give approval before the members can return to work. Instead of providing the promised help, the union members addiction treatment centers held the members against their will. They knew that the members wouldn’t leave treatment without the go-ahead because they didn’t want to lose their jobs.
During this time, the rehab centers drained hundreds of thousands of dollars out of the insurance companies. In the meantime, the union members missed time at work. In some cases, they never got the substance abuse treatment in which they enrolled.
Thankfully, not all rehab centers are out to make as much money as possible off of their clients. Many of them genuinely want to help people overcome addiction. These are the rehab centers that people need to put their trust in.
Legislation Protects People From Losing Jobs
Some union members never seek treatment because they’re afraid of losing their jobs. However, they can put these fears to rest when they know their rights. In fact, the Family and Medical Leave Act (FMLA) and the Americans with Disabilities Act (ADA) protect against this fear. They prevent companies from discriminating against employees who seek treatment.
Once people seek union members addiction treatment, they’re under protection from the ADA. This act ensures that companies can’t fire people because of addiction or the addiction treatment process. This extends to missing work as a result of getting treatment as well.
However, who does the ADA protect? It protects anyone who works in local or state governments. It also protects people who work for private companies with 15 or more employees.
What about the FMLA? This act qualifies people in the United States for up to 12 weeks of medical leave. It includes medical leave for addiction. Although the companies don’t have to pay employees during this leave, they can’t fire them.
